Texas Attorney General Ken Paxton has filed a lawsuit challenging the Biden administration’s regulatory overreach, suing to stop the federal Department of Transportation’s unlawful new greenhouse gas reporting measure.
The new federal rule requires the Texas Department of Transportation (TxDOT) to establish a declining carbon dioxide target associated with transportation as a performance measure for the Interstate and National Highway System. The federal government claims this mandate is necessary to meet the Biden administration’s goal of reducing greenhouse gas emissions to reach net-zero across the economy by 2050. The rule also requires TxDOT to measure and report progress toward the achievement of those targets.
The Department of Transportation does not have the statutory authority to institute such a rule, and the mandate violates the Administrative Procedure Act. Further, the rule is arbitrary and capricious and violates the Spending Clause by impermissibly restricting the use of federal funds by requiring TxDOT to implement the greenhouse gas measure.
“This is yet another example of the Biden Administration sidestepping the Constitution to make sweeping, destructive policies without authorization,” said Attorney General Paxton. “When Biden unleashes unlawful climate mandates that hurt our country, Texas is here to stop him.”

Good... Other AG's need to pile on and there are a whole host of other regulations that have been/are being promulgated that go well beyond Congressional Authorization...

The next step in the unwinding is that the legal apparatus in the blue and red states will begin attacking the federal government and each other in a form of lawfare until you begin to see some states outright ignore federal oversight.
All of this will put an unbearable strain on the SC as they attempt to find answers to an unsolvable situation, that being two sides with diametrically opposed agendas trying to operate under the same legal structure in what amounts to a zero sum game.
The only outcomes to this are the domination of one side of the other via various means of coercion, de federalization or separation.

Rational people realize this is coming and that it won't be pretty.

It is a none fact that Bush people wanted him out. It is also a known fact that Roy wanted him out. Without being in the conversation or able to hear the conversation I can tell you how the conversation went. If you were to think about the facts your should be able to also.

Not a lawyer and don't know know if it will come down to this, but this tells you who the real enemy is.
Had GOP presidents not picked Justices like Democrats, this thread would not exist.

Did you hear the "Bush people" giving Chip Roy marching orders in regards to Paxton? Yes or No?
