Yeah, that’s kinda the point of this thread. No idea why we were even contacted by their insurance. This should be an insurance v. insurance matter.

You shouldn't be a part of that discussion.
Sounds like they’re denying liability; most states are going to require a denial letter etc.

It doesn’t work this way.
So hitting a car and leaving the scene isn’t a crime anymore? I guess I was wrong. Please explain how it does work.

You could always call the driver who ran and tell them they can admit it to their insurance company or you can get the cops involved and the police report can prove she did it, but it will be after she’s charged with a criminal offense.
Don't do this. This could be considered extortion.

I’ll advise her to contact her insurance and go from there. Letter just arrived yesterday. Just weird. Some people are just complete scum.

You’re encouraging him to extort the vehicle’s registered owner.
The OP even admitted his wife does not know who hit her. They’re relying on a witness just to identify a possible suspect vehicle. Cops seem to already be involved and aren’t going to criminally charge the vehicle’s registered owner without an admission or probable cause that she was the driver.
Registered Owner =/= Driver
This isn’t complicated.

Wife is going to need some physical therapy. Six weeks. Maybe eight depending on the policy. PT won’t improve her and she’ll get sent out for MRIs. She is going to have some pain. Inflammation. Maybe a slight disc bulge. Time for the injections and/or therapy. This is where you get the big bucks.

Sounds like claim was made against your policy you would prefer it be against their policy

We didn’t file a claim on our insurance

Yes you did if you received money from your insurance company already.
You have uninsured motorist coverage I assume. Your insurance company will also subrogate if they deem you not at fault. If the other company still denies liability, it will go to a 3rd party arbitrator and they will determine fault.
Let your insurance company battle it out for you.

If the other insurance is denying your claim they have to notify you that it’s denied. Some states require a letter to be sent, some require just a phone call for denial. Pretty much all of them send denials via letter though.
Your insurance company will just pursue it through arb and may contact you for an additional recorded statement though.

Because they record those conversations and they hope they can trick you into saying something that shifts fault or at least mitigates it.
They like contributory negligence because they get to deny your claim AND raise rates on their client.

I’m sorry but that’s not extortion.
If you commit a crime and damage my property and I ask you to make restitution to compensate for the damaged property and you refuse, me informing you that I’m going to go to the cops and have you charged with the crime you committed so you will pay restitution, isn’t extortion.
If I make the crime up, then tell you to pay me or I’m going to the cops, that’s extortion. It’s not extortion when an actual crime was committed.

Her call.
Wouldn't even give her the option.

Send it to your insurance company. They should be handling this is you already filed a claim with them.

Giving any sort of either you do this or I do that is extortion you fool.
Why wouldn’t you just report to the cops and get your restitution if you had a case?

No, it isn't.
You have to have a threat, and I'm calling the police to let them investigate it isn't a threat.
You people are morons.

So if I watch someone take my property and I yell “hey, you give that back or I’m gonna call the cops!” I’m guilty of extortion?
