Mark Meadows on Tuesday demanded that the two charges leveled against him in Fulton County, Georgia, be moved to federal court — arguing that he was acting within the scope of his authority as a “federal official” when he engaged in the actions cited in the indictment against former President Donald Trump and 18 others.

quote:

“Mr. Meadows is entitled to remove this action to federal court because the charges against him plausibly give rise to a federal defense based on his role at all relevant times as the White House Chief of Staff to the President of the United States,” Meadows’ attorneys wrote in a Tuesday filing in the Northern District of Georgia.

“Nothing Mr. Meadows is alleged in the indictment to have done is criminal per se: arranging Oval Office meetings, contacting state officials on the President’s behalf, visiting a state government building, and setting up a phone call for the President. One would expect a Chief of Staff to the President of the United States to do these sorts of things,” the filing states

quote:

“This is precisely the kind of state interference in a federal official’s duties that the Supremacy Clause of the U.S. Constitution prohibits.”

The former Trump administration official seeks to have his case heard in the US District Court for the Northern District of Georgia, rather than Fulton County, where he will attempt to have the two charges against him dismissed.

“Mr. Meadows intends to file a motion to dismiss the indictment pursuant to Rule 12(b) of the Federal Rules of Criminal Procedure as soon as is feasible,” the filing states.

He's a Fed informant. They can't save him in Georgia.

It's weak. Everyone in the indictment would have the same "federal official" defense, considering they were all working for or in fact were POTUS.

A former federal judge says there is a provision that allows this to happen but he doubts a federal judge would view activities aligned with trying to overturn an election as part of his official duties. Time will tell.

When was Sidney Powell a federal official?

But, but, but Fanni said she was going to try all 19 defendants in her Fulton County Courtroom.

Fanni is even raising campaign funds off of current efforts.

Is Fanni lying to us?

yup

This indictment gets tossed the quickest

Pure, unadulterated election interference. This is a gift to Trump. Once tossed, his election will be guaranteed. DIMs are so desperate that theyve exposed their stupidity

They know Trump wins in a rematch.

This filing is sort of a big deal. They should all do it. When you remove a case to federal court, the state court's hands are completely tied unless and until the federal court sends it back to the state...which can take months for briefing, hearing, and ruling.

They are testing the waters for trumps removal.

He was acting as president protecting the constitutional republic and the integrity of one of its states elections.

It should be removed

Guess that’s why every democrat I know hopes republicans stay the course and nominate Trump because they are afraid of him. Nothing will turn out the democratic and independent vote on Election Day like Trump being the nominee.

I must have misunderstood your first post. Only like half of the defendants have the federal defenses to rely on.

A banana republic says Hi

Every time the DIMs have floated something to gain political advantage, manipulated currency, nuclear option, Bork, Thomas, Kavanaugh, court packing, etc it bites them in the arse

Going after your top opponent with the DOJ that you control, doesnt end well for them if they succeed

Biden is definitely vulnerable but he will beat Trump. Not sure why it’s so hard for some people to understand but 2020 was not about people wanting Biden it was about people hating Trump. You think his actions after the election and all these indictments are going to lessen that feeling in 2024? Sorry, don’t see it. Currently, he has like a 65% unfavorable rating with the American public. That’s not going to get better as these trials start.
