If Jack puts Trump in jail for a J6 charge will the DC judge allow bail?

I’m not trolling. I’m serious about this question. Speculation on this issue was raised by Julie Kelly on Steve Bannon’s War Room. The thinking behind denying bail is based on the current J6 defendants being detained and denied bail by a sitting DC judge appointed by Obama. Some of these J6 defendants have been sitting in prison over 2 years with still no trial. So much for your constitutional rights to a speedy trial.
And if bail is denied is there recourse? Can the defendant appeal to a higher court on the issue of bail denial?

If there is recourse, why have none of the other J6 defendants used it?
This his makes me think there is none.

Oh the melt here if they put him in jail and deny bail. Hell, some of the Cult45’s may even miss work.

The correct motion is a Motion for Writ of Habeas Corpus.
There is no way our current Supreme Court would allow a circuit judge to deny Trump bail. It is not that he is a flight risk.
Where is the further danger "caused" by Trump vs caused by the government persecution. Its not like Trump is going to lead the charge against the government.

That’s why I’m asking. There may be recourse under special circumstances. Under SS supervision?

I can't think of another way to signal to the entire world that the demise of the United States as a beacon of truth and freedom has ended than to jail a former president who is the main contender to win the next election.

Yeah, I’m thinking a J6 defendant with enough resources (money) can take it up to SCOTUS.

I’ve heard it said that a president could never be jailed for that reason. But it was pundits speculating.
Who knows with TDS flavored justice.

Trump is not going to prison. no way in hell is that happening.

They would like to house arrest.
I don’t see how you can put a former President in a regular jail.
Logistical nightmare.

Well - IF they were to jail Trump and IF they were then to deny him bail both before the election then he may well lead a true insurrection.

No bail for Trump. He will also get hit with a gag order.

a guilty verdict in state of new york long before j6 case starts or
a guilty verdict in atlanta long before j6 kicks off.
any of that means hes on loan from a sentence hes serving and already under lock and key.
he might be in ny prison months before.

I agree, but not because they fear any sort of backlash from Trump supporters.
