That begs some questions
Since they had her phone from the road (grass) and it was originally reported as kidnappimg - could they have gotten a judge to let them gain access?
Or if not then but they still had it when she came home - and if she refused to grant access when she came home - if they still have it can they get a judge to give them access due to investigation?
Another random question. If she is under investigation currently can they give her an order that she can’t leave the metro? To avoid flight risk?

I have zero idea how the law works but if she hasn't been accused of committing a crime at this time would they be able to do that?

Left behind at the scene, it’s evidence so yes.
They also have her call records, so they can subpoena records of people she spoke with to gain GPS data during their calls.

When the chief was reading his opening statement, he thanked the various law enforcement agencies who assisted in the investigation, including Secret Service. I thought Carlee might have been involved in counterfeiting somehow. But it was Secret Service who cracked the phone.

Those are reasonable if there were any doubts that she faked the whole thing. But based on the evidences accumulated and presented during yesterday’s conference, I think there is extreme to zero doubts that her version of events is bs.
I think Smollet may have more supporters willing to believe his story than Carlee.
Thus, accessing her phone maybe reveal the accomplice that picked her up after she abandoned her car, but would do little to further incriminate her.
