He doesn’t necessarily have to be doing at as a representative of the US government. Maybe it could just regarded as a release on behalf of pleading from a private citizen.

Don't know what the angle is for the Russians, but it wouldn't be a shocker if the Russians let him out on purpose to make Biden look bad (Or to make Trump look buddies with the Russians). Or to just piss off the Deep State.

They would lose it. Negotiating with a foreign power on behalf of the US without state department “approval”. They’d run him up on charges. Only Jimmy Carter is allowed to do stuff like this.
