Yea, I’m pretty sure they were arrested on State charges. I believe they were misdemeanor charges as well.

Well, you can be charged federally with a hate crime, yes.

But every State has their own hate crime laws as well…..

In the case of the 2 students, they were not charged federally….yet

Not necessarily. Louisiana enacted “hate crime” legislation in 1997. The fact that the arrests were made by local police (not federal law enforcement), indicates that these are state charges.

As to the OP, It appears that the women have not even yet been charged with anything. They were given the option of “house arrest” while the charging decisions are being made.

It is simply a form of pre-trial release for persons who have not yet been convicted of a crime. One would think that the high school students would be eligible for similar treatment, though it is far more likely that they will simply be released pending trial on a small bail, which is far less restrictive.

As to the Houma kids, your legislature (in its infinite wisdom) chose to enact hate crime legislation. These kids (arguably) violated those statutes, and they have been charged accordingly.
