Choosing to not prosecute a serious crime that ethically should be prosecuted is the same as prosecuting an innocent person.
Attempted burglary is a crime. Attempted rape is a crime. Attempted murder is a crime. Attempting to jail, successfully jailing, or preventing prison release of an obviously innocent man should be a crime.
