Child support question

If my ex wife (remarried) now makes the same as me or more (on her own) as I’ve heard from my son we share 50/50 together…is it reasonable to ask for a reduction or to stop paying altogether? I’m only supposed to pay 80% of anything related to him but I just pay 100% instead because I love him and don’t even want to fool with getting reimbursed from my ex wife or vice versa when she pays for some things completely. Just easier that way after 4 years and of course I know I need to go through an attorney which I could use a recommendation on as well that I can vet for potential hiring.

Nah. It's done by formula in LA. Only gray area would be if one party's income is difficult to ascertain.

Waiting til she files taxes for this year and she doesn’t get paid in cash. She’s a decent mother and got a new job that let her work at home as a consultant making really good money. Obviously I want to discuss with her first and take the right approach but we get along really well so hoping it won’t be a problem IF it’s even worth pursuing.

I have 50/50 joint physical and legal with my ex and pay no child support. She also makes about $17K a year more than me. We split insurance, tuition and any medical bills 50/50 too. Have you asked her about coming to an agreement where you're not paying support?

Child custody and financial responsibility no longer leans heavily to the mother. If in fact your income is 50/50 along with custody and is provable then you have an excellent chance at a significant reduction or no child support at all. When I went through my divorce the judge looked strictly at the income percentage and applied it to the tables and the fact that I had our child 80% of the time she paid me per month although a small amount.

This but it feels fricking good when she is the one that finally gets the script flipped. Good luck. Btw my ex called me on the last year that I payed her child support and asked where her money was. I overpaid her over the years and they (FL child support)sent me a letter stating this but I didn’t let her know about the letter. My reply when she called was CALL THE STATE and child services. CLICK(hung up on her). Over the 10 years I paid her child support that was always her response when I got fricked dealing with the state.

Impossible, she’s only able to make 70% of what you make.

Not following. When we divorced she was making less than me but now she either makes the same as me or even more than me. Bills are around 77/23 I believe, I’ve never missed a payment, and I don’t overpay.

Sounds like she needs to pay her fair share.

I pay fully for insurance and like I said 77/23 roughly for any medical expenses or certain other needs but we usually just pay 100% ourselves as long as her 100% isn’t that much.

And no, haven’t even discussed it yet. Really like how things are flowing but honestly I want to be able to provide more for him and feel this is hindering me. I’m a great father and want to be able to buy a house again one day instead of continuing to rent due to the support payments. I have no debt other than my car note but still it will take years to be able to buy again from where I see it.

I am not in Louisiana, but have the same situation with 50/50 joint custody and when my ex got a promotion I filed for an amended support figure. She hired an attorney, I handled my case myself and I still got the reduction (I was still making more), it is all a formula. And in Rhode Island at least, there are 2 formulas. 1 for when one parent has custody and another for 50/50 joint custody where the amount owed is significantly lower. We were both W-2 so there was no way to hide true income figures.
