Maryland State Police issued an agency-wide order Tuesday to continue enforcing Maryland's "handgun qualification law" despite a scathing court opinion calling the law unconstitutional.

According to the federal order signed Tuesday, Maryland officials have 14 days to file for a rehearing. If the state fails to do so, the federal appeals court will issue an automatic mandate seven days later. This option places a final court ruling for December 11.

Alternatively, Attorney General Anthony Brown’s office can appeal to the U.S. Supreme Court. The decision to appeal must be made no later than December 21.

I DO hope they appeal to the SC. Brown is pathetically underqualified to be any type of lawyer, let alone AG, continues to be motivated by purely political ambitions, and MD's unconstitutional burden doesn't stand a chance in front of any higher court.

Western MD sheriffs will not stand for this.

Unfortunately, western MD sheriffs run departments inadequately funded and staffed and are vastly outnumbered by sheriffs in places like Baltimore and Montgomery County.

Wonder what kind of fees the state police were collecting for the "qualification" process.

It is my understanding the entire process is costing upwards of $400.

Multiply that amount by the number of applicants and that will probably explain why they aren't complying with court's decision.

Nice this becomes final - let’s see if they continue to enforce it.

If so - it’s lawfare time.

I wonder if the above-the-fray moderates will call this a Constitutional crisis. I doubt it.

Maybe the next President should issue an EO mandating 'qualification' for voting and then ignore the courts and we can see how that turns out.

Y'all "back the blue no matter what" types need to think about this every time yall say, "the cops won't enforce a gun grabbing law". Yes they will. Some won't, but a majority will do what their boss says to do if they want to keep getting that paycheck.

They absolutely will. The majority of them love power and taking guns away from the populace only increases their power.

Not to hijack your thread but what happened here to have so many more firearm applicants than the year before

quote:

According to MSP, over 85,000 Marylanders applied for a handgun permit in 2022, compared to just over 12,000 in 2021.

That’s a 600% increase!

Sign of the times.

Leftist DA's don't prosecute.
Leftist cops don't protect/enforce.
Leftist police chiefs are doing all they can to force constitutionalist cops out.

Sheriffs need to arrest the first trooper enforcing the law for violation of oath of office and for false imprisonment of the citizen.

They will continue to do this and be the authoritarian shits they are until people decide to start exercising that amendment that sits between 1 and 3.

The draconian current law was implemented. Previous had been much, much more common sense and much less expensive. Everybody rushed out to get their permits.
Afterward the applications virtually dried up and the majority of gun stores went out of business.

"common sense" unconstitutional restriction of rights.

You need to remove common sense from your vocabulary when it comes to modifying the constitution.
