Legal question for fun - Boebart and her Beetlejuice handy

Here’s a question just for a fun debate.
As you know, the photo was released showing her giving her date a handy in the theater and the date giving her a nice boob feel.
It’s an infrared camera. The lights were off and the theater was dark. You cannot see around you in the dark. So you have the expectation that nobody can see you, even cameras.
Could you make a case that she had the expectation of privacy when the lights were off, or at least, the expectation of not being seen?

She wasn’t charged with anything criminal.
The question is should the photos have been released, not did she get caught doing something illegal.

I'd lay 1k that her nipples look like something off of a little Caesars special. You know she didn't have the sense to get a really good surgeon to bolt those on.

I don’t think there’s a case but I think it’s interesting and wanted to discuss it.
You walk into a public bathroom, you cannot have pictures yet you are in public. Why? Because you have the expectation of privacy in a bathroom despite it being a public bathroom.
