I am sure that after his drunken stunt at the pre season boosters' luncheon & all the resulting BS, the SC human resource dept made damn sure it was all well documented & that he was given the appropriate legal warnings. He did not get drunk once & get caught once by any meams. Depositions will clear a lot of shite up.

Sometimes when procedures aren't followed to the letter, good lawyers can dismantle them and win cases for their clients.
I think we all know Sark was in the wrong, but it's not a morality case, it's a legal one.
I'm guessing if his lawyer has done his due diligence there's a little smoke to this fire, and he'll probably win an out of court settlement.

I've tried to fire an alcoholic in California... Basically, any addict has the right to 30 days leave to seek rehabilitation without fear of losing his/her job.
This cas will settle out of court. He will probably get the value of his contract and a case of Jameson.

In California, addicts get 30 days leave (without pay) to get treatment without fear of losing his/her job. All he has to do is prove he told his boss he is an alcoholic. They then have to give him time.
This will settle out of court for a couple of million and a case of Jameson.

You're crazy if you think USC and all their lawyer resources didn't fully vet this possibility before firing him. I'd be willing to bet that they offered him the chance to get help and he declined, and thus was fired.

one of the clinical features of alcoholism is DENIAL. so Sark's initial refusing of help could potentially be interpreted as a symptom of being sick.
if this all plays out he has a decent chance of winning.
USC probably realizes this, and ultimately, as stated above, this will settle.

I would guess USC will settle to keep this ugly mess out of the public eye. They will not want the public to know what they knew and when they knew it. Just a guess.

It really doesn't matter all that much. It's a stunt to get a little cash, and they'll settle out of court to just make it go away. I doubt we'll hear much else out of it.

It's taught in business law classes that employers have to make reasonable accommodations for alcoholism, granted you can't show up to work drunk, so there's that. I suppose what is reasonable is up to the courts to decide. But it's a non-issue really, as it's almost certain they'll just settle out of court.
