Why not? There is no law against it. One of our employees put in his two week notice a couple of weeks ago. We tried to retain him, but he had already signed a contract, with non compete/solicit terms, and had taken a check. Our attorney said that as long as he hadn’t been paid he could have backed out, but it would have been dicey with him having accepted money (albeit uncashed).
Another example. We just started a new company with two partners who were working at a major consulting company. Each of them is an owner of newco. All of the paperwork, employment contracts and operating agreement, was executed before they resigned.
