quote:
Notice that the 14th Amendment uses citizens in one places, and persons in another. This means that non-citizens (“persons”) have due process and equal protection rights, once in the territory of the United States. The Fifth Amendment (which applies to the federal government) likewise uses the phrase “no person shall be . . . deprived of life, liberty, or property, without due process of law.” Long story short, you're wrong
I know I said I was moving on but by God then you had to show up. You've been posting that repeatedly and even though its been shredded on other boards I just can't let you drop it in here without a response.
Again, as I've said, a green card holder is still an alien, even within the US. Now, they have some constitutional protection while in the US but they have none, zero, nada while outside the US, ie, a foreign national. This is well settled in federal immigration law and you quoting passages of the 14th Amendment is not going to change that.
The President has broad powers re immigration law. Denying a foreign national immediate entry, even one with a green card, does not deny due process or liberty. You may not agree with it or like it, but it is not unconstitutional and the President has broad discretion to do it.
Foreign nationals being denied entry are not denied due process because 1, this is not a ban, it's increased vetting, 2, they don't have that right as a foreign national (outside the territory), 3, they are not being denied liberty, they are free to go.
So I'm sorry to tell you because I know you are so outraged but this eo will continue to stand, and will do so regardless of what one fed judge in manhattan does. I expect legal course to continue. You can usually tell when a case is going to be heard by the Supreme Court way before cert is issued because the circuits will be lining up on opposite sides but I'm not sure we will reach that point.
So i think we have each made our opinions known. Now how about we get back to soccer.

Bradley is a liberal little bitch. I'd bet anything one of the people Cameron talked about always arguing politics with on the NT is him. Too many liberal pussies nowadays
