Of course he's not. Just as with all the other Republican members of the committee he's bringing up bits of info that have no bearing on whether or not Ms. Lerner waived her Fifth Amendment rights. Here, let's have a short constitutional lesson. The House of Representatives has an inherent authority under the constitution to hold people in contempt without referring the case to the courts. Ex Parte Grossman went even as far as to say the president can't even pardon a person held in this manner.
Please educate yourself before speaking.
If she's held, there's nothing the DOJ can do. She'll have her day in court one way or the other- regardless of what the oppressed Attorney General says.
