I think it would need to be proven that Elmer knew money was being funnelled to hostile foreign powers. Somali terror groups may qualify but when the governor inevitablly pleads stupidity the reasonable doubt threshold likely saves his arse. It's not so hard to believe that he is that stupid. But racketeering seems pretty clearcut.

The revised statements against her tied her directly to the plot. You'll have to get similar testimony against Walz.
That testimony was later recanted, just FWIW. It was likely bullshite coerced by the government-prosecution.
