I said this in the other thread but here's what's going on and hopefully a clear explanation for this board.

Trump attracts ideologues and sycophants like Miller. Miller is so blinded by hatred of brown people that he ignores any sort of real legal analysis to actually effectuate change in a meaningful way. Instead, he asks shitty lawyers (there are precious few good lawyers left for this admin, since no good lawyers want to hitch their trailer to this loser admin) to come up with something that might (won't) stand up to legal analysis based on the same type of ideological themes seen on this board.

Examples: 'we're being invaded by Venezuelans!' 'It's an emergency! We need the tariffs!' 'migrants are scum'

Tariffs, Muslim ban, BRC, etc.

The problem with this is that while much of this board and MAGA loves the EOs, they inevitably fail because shitty lawyers pick shitty reasoning based on shitty ideological blanket statements instead of governing with any sort of decorum or strategy.

They are just as ideologically captured as the left is. Populism is a hell of a drug.

First, three SCOTUS justices said otherwise.

Second, the chosen statute gave Trump far more negotiating leeway with counterparties. Despite the court's eventual findings, those negotiated levels held.

In simple terms, if Trump had been capped by statute at 10% tariff levels, derivation of a 10% final result would be far more difficult than starting with a 20% proposal allowed under the alternate approach, followed with negotiation ... meeting halfway at 10%.

To me this is the fix when paired with earlier SC rulings. Step 1: continue to enforce the safe 3rd country rule while awaiting their asylum claim (which is sure to be denied). This means they have their baby in Mexico instead of the US. No BR citizenship to deal with in the first place. 2) deny entry visas to any woman 6 months or more pregnant. This eliminates a significant number of birth tourism issues. 3) ramp up deportation of the parents who are likely still in the country illegally. Very unlikely the child returns to the US on their own 10-15 years later when their entire lives and families are in their parents home country. Not ideal but probably solves 75% of the problem.

If he holds to his established historical record with EOs, one that is lacking any sound legal footing and is summarily tossed out of court.

This is one of the most pathetic things I’ve ever seen. Your validation comes from ringing up “wins” on an obscure, Louisiana-based sports website where you chronically post up to 18 hours a day while pretending to have a law practice.
