So he is going to close congress and recess appoint.

Article 2 section 3 specifically



Article II, Section 3, Clause 3 also authorizes the president to adjourn Congress if the House and Senate cannot agree on the time of adjournment; no president has ever had to exercise this administrative power.[34][35]

Which works perfectly because the senate doesn't want to adjourn and the house "does". they actually don't because they keep gaveling in even though no-one is there.

And it works perfectly to force the confirmation votes IMMEDIATELY upon the return to work of the Senate. Simple yes/no vote, no hem hawing around and filibustering, the recess appointment either is accepted or denied.
