He is on tape telling his attorney if she is to be paid it “must be on the up and up”. That alone should prevent prosecution. Who cares if he is a “good man”?

Hasn't another court already ruled that Daniels owes Trump $25m for violating the NDA? Doesn't that validate the NDA and the payment that secured it?
