The Swamp preparing to sue Trump for not spending enough.

The 1974 law cited by the State Department official was enacted amid anger over President Richard Nixon's decision to not spend — or “impound” — billions of dollars appropriated by a Congress that Nixon blamed for deficits and inflation. The law allows the executive branch to request permission from Congress to not use certain funds. But it also says any such request must offer lawmakers a specific and pragmatic rationale for holding on to the money. A general claim that the administration wants to shrink spending won't pass muster, experts said.
The law does give an administration leeway to defer spending available funds, but for limited amounts of time, depending on the program. Some observers expect Trump officials to rely heavily on such deferrals.
Trump’s budget critics note that the law gives the U.S. comptroller general power to sue an administration for not spending funds without a legitimate reason, according to an analysis recently circulated among concerned NGOs.

Why not be proactive and challenge the law in court? Don't sit back and wait for these assholes to shop for a judge, take it to court yourself.

What is the harm against the Trump admin? I don't understand the bases of a proactive lawsuit.

He's going to be sued anyway if he doesn't spend all of the money. Why wait around for them to file with the 9th circus? Be proactive and challenge the constitutionality of the law in a district that isn't the 9th circus. Always be on offense. You can't beat the left or the swamp if you just wait around and react to what they do.

I get your point but I'm pretty sure the judicial system doesn't work that way. They wouldn't have standing without harm.
The laws need to be changed on the legislative front.

I believe the final ruling will allow federal departments to NOT spend congressional appropriations unless specifically outlined in appropriation bills. That's just common sense, IMO. Probably won't even make it to SCOTUS.
