Posting a pic of Kagan while considering judicial lightweights misses the mark. Here is what Scalia said to Davis Axlerod before Kagan was nominated:

He wasn't done. Leaning forward, as if to share a confidential thought, he tried again. "Let me put a finer point on it," the justice said, in a lower, purposeful tone of voice, his eyes fixed on mine. "I hope he sends us Elena Kagan."

She had no judicial experience. She had not even litigated. She was purely a political appointment. And nothing that Justice Scalia purportedly said to David Axelrod changes that. And considering DA was a close confidant of President Obama, I find what he says highly suspect if not an outright lie.

He stated it as factual. In short, it is an allegation unless proven (by him or whomever) to be factual. Promoting an allegation as a fact without proof to support the claim makes him a liar. If he is stating an opinion, then it should be noted as such. Promoting an opinion as fact is disingenuous. It would be like me stating that you are a "piece of shite". That would simply be an opinion if I were to state it.
