Pretty sure that only applies to local and state law enforcement. I am almost certain that making false statements to the FBI is a different animal. You don't have to be under oath to be prosecuted.

Of course, there is no evidence Flynn LIED to them in the first place. All we know is they interviewed him.

It's illegal to knowingly make false statements to the FBI. No need to be under oath.

I am sure trump invited sessions into his office and said - don't prosecute.

That doesn't happen. DOJ is a separate organ rightly divining Justice.
