Can you help me understand what a citizens arrest is and the protocol for making one? Cause I'm assuming it's not ambush a suspect and shoot from multiple angles. Police follow a specific protocol before they pull the trigger. Even police in a rough situation have to prove their life was in imminent danger before shooting a suspect.

Duh and their standard to stop people from what I recall is reasonable suspicion, I believe for a citizen's arrest the law requires probable cause IE the vigilante actually witnessed the person commit the felony

It seems the "violent response" was due to him charging the son and trying to take his shotgun. It seems clear in the video that he lunges at the son. I can't see anyone moving toward him prior to that.

Yeah in lawful self-defense considering THEY accosted him and they didn't witness him commit a felony, you're arguing complete idiocy with this

I could give like 50. But, they would all be conjecture. I'm content to let the information come out, a trial to occur, and the defense to present its case. In either case, your lack of imagination doesn't really matter. The reality is, you know VERY little at this point. And, one would think that even a LITTLE awareness of history of the media in similar cases would slow you down a bit.

Shorty, you and I are 100% in lockstep on every issue politically or legally since I've posted on this website but I have to disagree here. This entire situation is BAD from every angle, unless a crazy bombshell changes the game there is no valid legal defense for what they did and there's no moral defense for what they did since they accosted him first, it's clearly a unanimous loser at this point.

SlowPro, per usual you are on the money with this one, keep up the good work we need more of you in the legal profession

the issue is their defenses to this killing.

which will be VERY HARD to establish since they literally have ZERO from a citizen's arrest perspective and likely won't have much from a self-defense since they accosted Arbery with arms. Let's call it what it is a SLAM DUNK for the jury to convict, it's that simple legally.

the issue is their defenses to this killing. those defenses will be much more legal than factual, and the factual issues we have on camera (outside of the present sense impressions of the son, which we have memorialized in a police report already)

criminal law professors always say the only thing that matters in criminal cases are the facts, the facts, and the facts, the legal stuff is just base stuff

More damning video released of your hero Ahmaud Arbery making an unathorized (and unlawful) entry into, what appears to be, a home under construction. He gets caught and they chase him out the house. He enters through the open garage and makes a hasty exit through the front door. Mr. Arbery proceeds to "haul-arse" down the street out of that neighborhood in the most expeditious means possible.

All this depends on whether the McMichaels WITNESSED THE COMMISSION OF THE FELONY, MORON, damn your idiocy would get shredded within 5 seconds in a courtroom you pull that bullshite, this doesn't mean anything to their criminal fate

When I first saw the video of the shooting, I thought they should be hanged. Now a video comes out showing Ahmaud entering a house under construction on the street. A neighbor called the police and later Ahmaud runs out of the house and down the street. If the father and son tried to make a "citizens arrest" and Ahmaud grabs the shotgun then that changes everything.

No it doesn't because THEY DIDN'T WITNESS IT, that's the law in Georgia, man we have so many law idiots here it's literally insane

Your ongoing insulting manner shows you’re likely not overly intelligent; you already proved it in a response to me.

Okay I'll add the "MORON" moniker to my list. Shredded within 5 seconds did you say Mr. Perry Mason? Video doesn't lie, The guy commited a crime. He entered a house illegally. That's why the neighbor was seen in the video calling the PO PO. We call that a crime Mr. Mason! By the way....are you a trial lawyer specializing in criminal law? Are you a democrat? Just askin!

Travis & Greg McMichael will walk. They should never have been arrested in the first place. Some jurisdiction is going to owe these guys a lot of money.

Holy shite. 13 of the last 15 posts in this thread are yours. That has to be a record. I have no idea if they are duplicates or not though.

None of that matters unless you prove intent to commit a felony you bitch? If you can't prove that, all you got is trespass which MOST TIMES isn't a felony, mostly a misdemeanor. Moreover, you got proof the two who committed the likely murder against Arbery witnessed this or had immediate knowledge if this was a felony? We're WAITINGGGGGGG

Let me see here.......okay.......added "you bitch" to my list. So are you telling me that a video of a guy who momentarily stands on the street, looks at said house, then moves and enters house is NOT considered to be "intent to commit a felony" Is that what you're saying Mr. Perry Mason?

Simple question? Is entering a house (or business) without the permission of the owner NOT a felony crime? Is is a misdemeaner? Am I subject to arrest if I enter a business (or residence) without the owners permission?

You didn't answer my question? Are you a trial lawyer specializing in criminal law?

Maybe he just wanted to explore the future house, see I just debunked your burglary argument in one fail swoop, you don't have any proof just stop brah

Good try Mr. Mason. But clearly in the video we can see that the neighbor across the street sees Mr. Arbery enter the house AND and is filmed making a......(wait for it).........PHONE call. Care to guess who he might be calling? Remember the PO PO confirms receiving a....... "PHONE CALL" at that time?

Oh and I do appreciate you refraining from calling me "you bitch". The "brah" moniker is okay?

Anyway, I'm bored. Good night!
