I'm not saying I fully agree with it but it's the same here in Oklahoma. Intoxication + having immediate access to a firearm = illegal possession... even if you have a CCP. You can find a grey area if there's another CCP holder with you who has their firearm concealed and on their person, but state law also prohibits any form of carry in "any establishment whose primary source of revenue is the sale of alcohol", so bars are off limits even if you're only the DD.

Look, the point is we all extrapolate and interpret meaning from the BOR to some degree. It’s why we have an entire branch of government devoted to this.

Can you link that for me? Not doubting, just wondering when this was and what the extent of it is.

When I was younger and far more into hunting we had to make damned sure we had neither firearms nor even ammo in the truck if we went out around the camp at night to spotlight deer. Being caught by W&F with even just a loose shell in the glove compartment but not firearm to fire it was enough for them.

To conceal carry* (have it in your car) it outside your home you need a CHL.

Well it’s happening everywhere. What is being done is Houston is terrible, and whether or not Oliver was arrested there or not does not change that.

Being intoxicated and being in possession of a firearm is not illegal in the state of Louisiana unless youre a concealed carry permit holder. And that's only as a condition of your permit.

And yet people still will tell you that Texas is all about guns and pro-second Amendment. For Christ's sakes people. They just passed open carry a few years ago. Louisiana has always been an open carry state.

In short, frick fake arse Texas.

The Supreme Court never ruled that your car is an extension of your home. There are constitutional protections you have in your home that you do not in your car. One big one being law enforcement cannot search you home without a warrant, but only probable cause is required to search your car. The scotus did rule in favor of what is called the “ automobile exception” which says 4th amendment protections extend to your car if it is parked in the driveway of your home.
