My nephew was there - flew up on Roger stone’s plane.
He said there were supposed to be 2 stages where speakers and bands were going to play in front and behind the Capitol.
That’s what they were going to Capitol for.
When they got there the stages had been destroyed.
And the police invited people in.
This was a set up and Trump didn’t participate one bit in insurrection.

Not required. That the Colorado Supreme Court made a factual finding that he did so and was ineligible is all that's required per the 14th Amendment.

There actually was a trial (at the district court level)

Holy frick you are an idiot. The Colorado Supreme Court can not find him guilty of insurrection; they are an appeals court, not a trial court. Their only functions are to determine if a lower state court’s finding is constitutional or not on its face and if the laws governing the state of Colorado were followed properly during a lower court’s trial process. Supreme Courts do NOT determine guilt or innocence.

To be fair, that fact-finding occurs at the District (or whatever nomenclature CO uses) level.

This isn’t a categorically true statement. Better to just stay away from it. It’s nuanced by state, and, for the record, SCOTUS has original jurisdiction over certain areas as well.
No need to get out over our skis on this one. The CO SC is going to get slapped around.

I'm surprised they determined Trump had standing.

He’s the specific target of the state’s action. Why wouldn’t he have standing?

If they follow original and textualist principles, POTUS is NOT an “officer of the United States”
Except in the emoluments clause. Although Trump argues that doesn't apply to POTUS either, no one agrees with him.
Or the disqualification language of the impeachment power? Article 1, section 3 says Congress can disqualify an impeached person from holding any office under the United States.
Do you believe a person who has been convicted of impeachment and disqualified from holding office can still run for President?

Who was convicted of impeachment?

explain to me what constitutional right a state can unilaterally take away from someone???
States can, like, put you in jail, take away your voting rights, and execute you… with due process. So yeah that could be the issue. What is the due process standard applicable to this decision?

He won’t. He will just keep getting his info from Twitter and press statements (not fact checked) because that’s faster and doesn’t require real discernment or intelligence.

Or, as I refer to them, Justice Wise Latina and Justice Diversity Hire.

What was the ultimate goal of January 6th?
Which part?
The part that's resulted in scores of felony convictions.

You do realize the 14th amendment authorizes congress to make exactly these laws right? And they have yet to do so in this instance.
It's self-executing, since it was used in the past and no laws had then been made as you say.

What due process do you think is required to trigger this clause of the 14th?
Whatever it was, Colorado and Maine judges consider it satisfied.

At the moment, this is incorrect. Per the Colorado Supreme Court.
