You do realize the 14th amendment authorizes congress to make exactly these laws right? And they have yet to do so in this instance.

What due process do you think is required to trigger this clause of the 14th?

2nd - the statement above shows you have zero knowledge of how the state or federal court systems work. Hint- state supreme courts NEVER make factual findings.
