The district court has to make the decision based on this ruling.
Since they did not, the USSC can't make the call, today. The case has to go back to the district court to make the determination.

In the absence of anything damning (recordings, documentary proof, etc) that Trump was doing anything other than speaking to the folks at the rally, all of the actual evidence would indicate that he wanted the protesters to disperse and go home (per the Insurrection Act) would strip any argument saying otherwise.

The 2 charges related to obstruction of official proceeding got tossed last week.
What charges are left to judge against the "official" standard?
