re: SCOTUS lets 'ghost gun' ban stand (while the underlying case is pending)

The application for stay presented to Justice Alito and by him referred to the Court is granted. The June 30, 2023 order and July 5, 2023 judgment of the United States District Court for the Northern District of Texas, case No. 4:22-cv-691, insofar as they vacate the final rule of the Bureau of Alcohol, Tobacco, Firearms and Explosives, 87 Fed. Reg. 24652 (April 26, 2022), are stayed pending the disposition of the appeal in the United States Court of Appeals for the Fifth Circuit and disposition of a petition for a writ of certiorari, if such a writ is timely sought. Should certiorari be denied, this stay shall terminate automatically. In the event certiorari is granted, the stay shall terminate upon the sending down of the judgment of this Court.
Justice Thomas, Justice Alito, Justice Gorsuch, and Justice Kavanaugh would deny the application for stay.
This has no bearing on my comment. SCOTUS reinstates ban on ghost guns. They can choose to side with freedom or lack of freedom. They chose a lack of freedom. Choosing freedom doesn't prevent the case from more looks by the courts, and doesn't prevent a full on destruction of the ATF's position.
The Biden administration came to the Supreme Court on July 27, asking the justices to intervene. Prelogar told the justices that while O’Connor’s order remains in effect and ghost guns can be sold without being subject to federal firearms laws, “the damage is done”; law-enforcement officials will not be able to trace those ghost guns in the future. So the Biden admin wants to restrict freedom and claims there is damage done to the government, but ignores the damage done to freedom and the exercise of rights, which take precedence over the government's quest for more power, and the court sided with the government.
Because just one judge can invalidate an agency’s actions, she observed, it encourages plaintiffs to seek out judges who might give them a favorable ruling. “And it operates asymmetrically,” she added: Only one set of challengers needs to prevail to block the agency action nationwide, while the government needs to defeat all of the challengers. The ability to issue a universal injunction also effectively gives a single district judge “veto power” over any other pending challenges – of which, in the case of the ghost-guns rule, there are several. This is rich coming from Democrats. A court with any balls and any brains would laugh at this argument from Democrats. But the courts continually bend over for the government, over and over and over again.
The Supreme Court on Tuesday allowed the Biden administration to temporarily reinstate a rule by the Bureau of Alcohol, Tobacco, Firearms, and Explosives regulating “ghost guns” while a challenge to the rule continues in a federal appeals court.
Our federal judiciary sucks. They can keep the lower court ruling intact while the appeal continues.

Allows enforcement while case is litigated. Not a decision on the merits

I don't care about your comment. You're someone who believes we win by executive action and an activist judiciary. You're not a serious person.

Neither are you because you refuse to debate where gun laws originated. You just ignore it.

Right, because you're arguing a point I haven't made.

Gun control is racist and classist as frick.
What's your point?

If you expected a Court interventionalist in ACB, you were set up for disappointment.

We'll see where she falls when this case eventually arrives in regular order to SCOTUS.

The three commie justices make no bones about legislating from the bench. They will always vote for more government control and more restrictions of civil rights.
Roberts is a bought and paid for stooge.
ACB is what is upsetting. They should be quickly striking dead any and every single gun law or “rule” post-Bruen as there is no historical analog of gun regulation or restrictions at the time of the ratification of the bill of rights.
F’em all to hell. Wish for once I believed in hell because that’s where they deserve to go.

I took your critique into consideration.
How's it look now?

Well thanks.
That's pretty high praise for amatuer journalist.

Neither one are conservative. ACB was championed on this board because she's Catholic, moderately attractive for her age and I think she has ties to Louisiana. She was never a good choice.
Correct me if I am wrong, but ACB was mentored by Roberts' sorry arse. So, not surprising.

Yes. The left is expert about creating emotional terms like "fossil fuels" and "ghost gun" to create fear and emotions.
They can all go to hell. The Constitution was designed to restrict what government can do, not the people The usage of language is bullshite, and it works on the women, and half of the men. "Fossil" must be bad! "Ghost guns" must be bad! FU. Not relevant.
