You really don't understand how our government works do you?
We the people grant certain powers to the government and agree upon guaranteed protection of certain rights from the government. Marriage is not one of them.

Why don't you tell me what you think marriage is then that it is so godawful necessary that the government involve itself. You do realize that marriage existed for centuries without government involvement? I assure you that whether I have a religious marriage, a civil marriage, or I just sign a contract with my "spouse", the courts will enforce the contractual commitments the same way.

They don't.Unless you live in a common law state. And common law marriage is insane to me. I am unaware of a law that forbids people from living together on the basis of race or sexual orientation.
But there's nothing wrong with two people entering into a private contract to legally share their lives and join their personhood and the government enforcing that contract.

Government recognition of marriage is not about conferring "rights" upon people. It's nothing but to assist the ease of functioning in civil society for necessary things such as successions, progeny, etc.
