He's been that way the entire time aside from so pre-trial stuff that didn't have any business being in the trial.

And I agree with him. The finder of fact should have all relevant information available to them with an error on the side of providing too much.

Relevant information has to have some type of basis in evidence, this is just being made up.

Nobody is really testifying as to anything, this is all made up.

The defense is failing to properly object.

They will be asked to determine if they video shows beyond a reasonable doubt that Mr. Rittenhouse pointed his gun at Mr. Ziminski and that provoked Mr. Rosenbaum to charge at Mr. Rittenhouse.

In my opinion, there is no way that any reasonable person could even come close to concluding that.

There is no testimony as to that. (the prosecutor is saying that, at least my take)

The judge didn’t screw the defense. The judge isn’t the finder of fact. The jury is.

There’s not a juror with any reasonableness that will buy the state’s argument that Kyle provoked the attack from someone who twice stated before that he was going to kill Kyle.

Also, this is just jury instructions. Defense still has directed verdict motion to go.

Plus, closing arguments.

If the state’s case wasn’t strong (and it wasn’t by a LONG shot), it’s not going to suddenly become strong on the sole basis that the state gets to argue in closing what they’ve been arguing the entire trial and that hasn’t convinced anyone.

The prosecution will argue that in closing. It's their entire case. Which shows you how laughable this trial is that their entire case hinges on that video.

True, but there is no contested facts, meaning these things were not part of testimony at trial.

They are coming up with theories after the fact.
