Ofc. Luckey & Sgt. Johnson... both of whom have already testified for the prosecution... are on the defense's witness list as well

as is the guy who was the actual Chief of Police on the day of the incident

prosecution going after Potter's status in the PD union again... draws and objection and gets told to stop and move on by the judge

IMO, unless the cop wasn’t wearing her taser in the properly trained position, or other such negligent practice, her mistaken action under pressure doesn’t rise to a criminal offense. Civil liability, yes, but not criminal.

There needs to be demonstrated that she made a negligent conscious choice which caused the death, and not simply making a mistake in the heat of battle.

court's done for the day so the jury can not die driving home on slick, snow-covered roads

last 2 witnesses for the day were nothing witnesses... no real information of note from either of them

What does this add? This is all cumulative evidence that is not at dispute.

This testimony is just a waste and is losing me; I suspect the jury is tuning out as well.

also... the prosecutor will make sure the M.E. says repeatedly his listed manner of death is "homicide" even though a medical definition of homicide & legal definition of homicide are 2 completely different things

I get that; however Earl Grey got two state witnesses to admit that she was justified with her actions.

The State case is just so weak and playing the emotional game.

Maybe I am just too logical but the State is losing me with each additional witness.

Nick Rekieta just said the main thing here... this happens in courts every day in this country

essentially prosecutors run up the clock to drain the defendant's resources (i.e. running up the bill for the defense attorney... costing the defendant more money)

again... as noted.. homicide in a medical sense is different from homicide in a legal sense

ETA: made sure to say it twice... and that in his report he had noted the shot was by a "law enforcement officer"

Can this not be considered prejudicial testimony? The purpose of the trial is to determine that fact?

the thing is... the state has spent 0 time trying to show how Potter acted maliciously or recklessly... which is the main issue at play here

Exactly; this is my issue with this whole trial. The state is harping on the fact that Wright was shot and is dead but that is not the issue of the trial.

The defense conceded that Kim shot him. The state's case has shown nothing regarding any reckless or malicious conduct. What a farce.
