This was O'Reilly's take on Beck this morning. He can try to hide behind the 1A if he didn't go inside. Which I can see, but not sure what the different law is for other people that didn't go in. Some of the proud boys and oathkeepers were charged with just helping orchestrate but didn't even show up in DC that day. IIRC the gay guy that leads the gay group against democrats got arrested and under house arrest, but I don't think he went in either.
Some kind of communication law to use against these people? I guess under these same rules an officer that attacks the congress or WH, but only sends soldiers in but sits backs and watches won't get charges against him. Epps is on camera doing what would have been done 50+ yrs ago if there was an "insurrection" in DC, but some how him not using current tech advances, changes his guilt.
Also, if this is the real reason he isn't getting cahrged, then someone needs to tell democrats that Trump didn't go in either, so drop their charges and he should be able to sue media that says he caused the insurrection. Cause no one is recorded to be more instigating an insurrection than Ray Epps.

Ohhh to add...turns out Epps lawyer is a former Perkins Coie lawyer, and now works with David Brock who use to run Media Matters.

It would be like saying we aren’t going to prosecute someone for a crime that they instigated because they are a member of a gang.
Which is pretty much my point to him, in not so many words, by flipping the question around. I'm guessing you saw his idiotic reply. There's something about these clowns & their mental illness that prevents them from processing anything with the slightest nuance or strays at all from the literal.

You're more than welcome to offer your definition of "actually participating", but I would suggest reading below first.
18 U.S. Code § 2383 - Rebellion or insurrection
Whoever incites, sets on foot, assists, or engages in any rebellion or insurrection against the authority of the United States or the laws thereof, or gives aid or comfort thereto, shall be fined under this title or imprisoned not more than ten years, or both
18 U.S. Code § 2102 - Definitions
(a) As used in this chapter, the term “riot” means a public disturbance involving (1) an act or acts of violence by one or more persons part of an assemblage of three or more persons, which act or acts shall constitute a clear and present danger of, or shall result in, damage or injury to the property of any other person or to the person of any other individual or (2) a threat or threats of the commission of an act or acts of violence by one or more persons part of an assemblage of three or more persons having, individually or collectively, the ability of immediate execution of such threat or threats, where the performance of the threatened act or acts of violence would constitute a clear and present danger of, or would result in, damage or injury to the property of any other person or to the person of any other individual.
(b) As used in this chapter, the term “to incite a riot”, or “to organize, promote, encourage, participate in, or carry on a riot”, includes, but is not limited to, urging or instigating other persons to riot, but shall not be deemed to mean the mere oral or written (1) advocacy of ideas or (2) expression of belief, not involving advocacy of any act or acts of violence or assertion of the rightness of, or the right to commit, any such act or acts.
I believe there are/were over 200 people charged with violating the following Federal Law...
This is also the exact same law violated by the pro-abortion lunatics protesting outside of the homes of SCOTUS judges on a nightly basis following the Roe v. Wade leak. Not a single arrest was made for this crime.

Whoever, with the intent of interfering with, obstructing, or impeding the administration of justice, or with the intent of influencing any judge, juror, witness, or court officer, in the discharge of his duty, pickets or parades in or near a building housing a court of the United States, or in or near a building or residence occupied or used by such judge, juror, witness, or court officer, or with such intent uses any sound-truck or similar device or resorts to any other demonstration in or near any such building or residence, shall be fined under this title or imprisoned not more than one year, or both.
Nothing in this section shall interfere with or prevent the exercise by any court of the United States of its power to punish for contempt.

By code 2383 they would seem to have him nailed. He definitely was involved in inciting an insurrection according to that code. But that seems a low bar that could mean arresting a whole lot more people, way more than have already been arrested.
