PT lawyers, is Skeletor blocking VSG GEOTUS from giving SOTU unconstitutional?

Article II Section 3 of the Constitution states: “He shall from time to time give to the Congress Information of the State of the Union”

He is bound by law to give the speech. Skeletor preventing that is causing a constitutional violation, right?

Im sure there is a clause giving the speaker power to avoid getting dunked on for an hour.

I won't pretend to know much, but it's probably a stretch to call it "unconstitutional." Maybe it's been expounded on over time, but "from time to time" is sort of a vague description. I think it being an annual address is more tradition than anything else. Would be interested in hearing more learned opinions.

That being said, I hope Trump makes Pelosi and democrats pay dearly for this petty act of defiance.

he has the option of filing a written report, that was the original method

Nancy has already formally invited him and TRUMP has already accepted. He twweted last week that a contact is a contract. I suppose that means he could hold her to it if he really wants to.

No. He is by law required to give the information. He can send an e-mail. He doesn't have to speak.

All he has to do per constitution is give a report on the state of the union. For 110 or so years it was done by letter. He can’t go to the house of reps and give a speech without being invited.

Probably not.

The annual in person state of the union is more of a tradition than anything.

In the old days the state of the union was often times just written and distributed to Congress.

Just tweet the SOTU. Just as many people will see it and the media going apeshit will be enough to broadcast it.

I don’t believe Pelosi can stop Trump from doing a SOTU/rally somewhere if Trump decides that’s what he wants to do.

Nothing about giving it in person in the House. Was only written in letter form for most of our history.

He should give it in front of the MLK memorial reminding Americans (Nancy too) that this guy(MLK) knew how to work with people for the benefit of all people.

But he is not bound to give it at any specific time or place. "Congress" is wherever they meet together, not a building, not a room. "Congress" are the people who make up Congress. He could give the SOTU at a Waffle House if Congress showed up for some smothered and covered.

The Speaker of the House pretty much runs the house side of Congress, so it's completely within her power to deny the president that venue. It's petty and it's never really been done, but there's no reason she can't do so.

The president can give the SOTU wherever he wants. He doesn't even have to give a speech. He could even write them a letter.
