quote:Thank you. I think that analysis definitely would apply to privilege materials. My question is whether everything requested under the subpoena was actually privileged. If the witness refuses to produce anything, what tools available to resolve that question, other than an attempt to enforce the subpoena by the body which issued it?
Validly issued" isn't the gist of the analysis. Rather, assertion of Executive Privilege.
Why is it “unconservative” to seek that enforcement and thereby obtain that determination?
Is there not a certain amount of kowtowing involved to simply accept the assertion that everything requested was indeed subject to the privilege in question?
To be very clear, there is no doubt in my mind that the administration is entitled to ask for citizenship question on the census form, provided that it follows the statutory requirements for such an inclusion. Assuming that the subpoenas in question were intended to determine whether those procedures were indeed followed by the administration, does the privilege even apply?
Again, however, my interest in this thread is to determine why his actions as are perceived as not being “conservative. It seems that the analysis does not go much further than “he is not supporting Trump.”

I don’t agree with the question they’re putting on the census because it’s flagrantly unconstitutional, but the White House has every right to use executive privilege and take Congress to court over this.

democrats have weaponized congress. They are using bull shite investigations to harass and intimidate their political opponents. These police state tactics are used in banana republics.
Which leaves 2 options: 1) a peaceable divorce with the property divided 50/50, or 2) a purge and we keep it all.
ETA: Well really three options with the third being do nothing and regress into socialism and eventually communism by way of voter fraud and a dumbed down nation.

As I understand it the USSC is to be releasing its opinion on the issue of constitutionality of the question(s) pursuant to the recent litigation of that issue. Congressional Dems and Amash likely should have waited on that decision prior to their contempt actions. Because they did not temporarily hold off it reeks of political games. A opinion one way or the other moots the issue for Congress....if ruled constitutional, nothing further to investigate and challenge. If ruled unconstitutional, problem solved for Congress bc it's then a non-issue.

Who do you think runs this website? Harvard Journal of Law & Public Policy?

Is it “conservative” to enable a witness in ignoring such a subpoena?
if he never spoke out then, then he is nothing more than an opportunist hack

Yeah, I'm sure Amash is just going along with this because of principles and shite.
Kinda like how the "principled Libertarian" Amash just completely ignores the fact that Trump's campaign was spied on and calls for Trump's impeachment over obstructing their witch hunt.

Hell, link me to LiberalHank criticizing a democrat over anything. Dude's the only libertarian in history to never criticise a democrat.
