question for any of the legal minds on here - could a challenge be mounted against this based on the new "Right to Try" law?

Suzeanna and Matthew Brill of Macon were arrested in April on reckless conduct charges after an investigation by the Georgia Division of Family and Children Services determined the pair had allowed their son, David, to smoke marijuana to deal with the seizures, Twiggs County Sheriff Darren Mitchum said in a press conference Thursday.

The couple began giving their son marijuana in February, Steve Sadow, who is representing the family pro bono, told ABC News.

“That was the last ditch effort. They had tried all the medical treatments and pharmaceuticals recommended or prescribed,” Sadow said.

I agree completely with a caveat. My best friend growing up began to get stoned regularly with his Dad at age 13. It fricked him up for a lifetime. That’s why you have to have some kind of ground rules, because for every legitimate situation there is another case of child abuse via drug use. This is the kind of thing a prosecutor should just throw out.

I'm not sure how this is relevant. I don't think anyone advocates for recreational marijuana use for minors.

If it’s established that they were legitimately letting him smoke pot for seizures, this case should probably be dismissed and the parents educated on the ingredients in pot which are therapeutic for their son.

I have a son who was diagnosed with juvenile myoclonic epilepsy. He's in his early thirties now and controls it through getting proper rest and sleep, exercise, staying away from drinking more than one or two alcoholic drinks and then just on occasion. He also takes the drug Depakote.

He tried the marijuana route for a while, but it negatively impacted his ability to work and think critically, and was more expensive overall anyway, than using the drug.

Different results for different people. I'm glad the kids in the story was not experiencing seizures while using it, but this also shows the absurdity of state laws against medical use.

The FDA just a month ago approved a new drug, derived from cannabis, that is to treat epilepsy and seizures. Finally! It would be the very first FDA approved prescription drug use of cannabis to treat illnesses.

I think that by default, that is the State’s position. They aren’t recognizing the medical legitimacy. Which is foolish and oppressive.

They should move to Florida where CBD oil is now legal.

Cbd oil is legal in Georgia, but I don’t think that there are any legal suppliers.

Yea I was going to say i thought that just recently passed here but there probably is no suppliers yet.

It could be a really hot industry here soon.

There are a lot of online suppliers. We ordered it to help our corgi as she got older to help with her arthritis. Mymomorders it in Louisiana and uses it to treat fibromyalgia (I know, it's in in her head), and I have an associate that has a nerve problem in his jaw that gives him splitting headaches, and he orders it and uses it to treat that (along with using Botox on it).

I guess they could seize those company's records, track down and imprison everyone, though. Jeff Sessions... Yes, I'm looking at you.

Dad shouldn't be testing positive then, if the treatment was the ONLY help for his son, amirite?

He should go to jail: unlicensed medical provider, contributing to the delinquency, possession, intent, and a whole gaggle of others

If ole Dad doesn't test positive, then I might be more obliged to take his word. Now I dont

It can be bought at health food stores in Arkansas. Bought some for my hound when she was dying from cancer last year. It appeared to give her some relief at the time.

Correct. Unfortunately I don't have that much faith in our legal system.

Although now that this has made national news it could be a political nightmare for the prosecution to NOT throw it out.

That's one good thing about the internet. It brings these things to light and at least has the potential to put pressure on people to do the rectify the situation since everyone is watching.
