The ultimate "small government" is no government.
In a theoretical, no-government world, aka Libertarian anarchy, individuals would be free to do as they pleased, albeit temporarily.
I say 'temporarily' because, in anarchy, personal freedom quickly impacts someone else's freedoms. Rape, plunder, murder would be a few examples. Those are undesirable elements which even a small unobtrusive government would be useful in mitigating. Equal application of law in such instances would in no way represent "Big Government."

Are you trying to promote the Equal Protection Clause based on its historical policy, the current legal framework, or the revolutionary change from that case in California?

I'm attempting to get you to quit bitching about your situation or that of your clients, and do something about it.
That starts with your acknowledgement of the problem instead of issuing lawfare whataboutisms to nonlawyers, whom you should be able instead into convert to accolades of your position. Instead of TDS, you should view this bullshite as an opportunity to bring your positions home.
