quote:Yes, because he could've asked for a stricter standard. FISC judges can block standards from loosening past a certain point. But they have no power over Trump making standards tighter, that would be his prerogative as the executive.
So a judge nominated by someone else wrote an opinion in line with Trump...and it;s his fault she did it?
Since he doesn't actually give a shite about civil liberties, he didn't.

Hmmm. I don't remember that conversation but I used to drink a lot.

So it's his fault this judge did what she did.
I love this logic.
he made her do it, right? Through mind control or something?

The judge adopted a standard proposed by Trump. Trump could've asked for a stricter one and the judge would've been fine with it, because there's nothing unconstitutional about an executive adopting a stricter interpretation of the 4th amendment than the courts allow.

and the jusge could have said no, and gone with stricter.
See, thats the problem with your neo-lib thinking.
This beautiful intelligent Obozo appointee couldnt do that, so instead it has to be Trumps fault.

When on Earth did Trump set any standards for FISC? Congress creates acts and laws to set standards for FISC big dog.

The executive branch does not interpret laws, thats the judiciary homie.
I totally agree that a huge amount of what the NSA does is horseshite, but you hope Trump gets nailed over Obama FISC appointments authorizing shady collections based on the laws and acts put in place by congress years before Trump took office?

Mate, where were these threads a year ago? Odd.

Iosh and I have been arguing about this, enhanced interrogation, the legality of targeted strikes against US citizens embedded among enemy actors in combat zones, etc. since 2013 or so. We only kind of agreed on torture. His positions haven't changed because of Trump's election (unlike some folks).

This is one area where I feel Trump will definitely be lead by his nose.
He has no idea what to do in regards to these programs and his advisors appear to be pro-expansion.

I have no doubt his positions are honest, just amusing that he is starting these threads now.

Man, this thread is perfectly indicative of one of the biggest concerns I've had with trump.
He's so exceedingly polarizing that every issue just immediately diverts to being about him rather than the issue. Virtually every single post in this thread has been a bitch-fit centering on Trump's fault/not Trump's fault that the substance of what actually happened has gotten completely lost.
There is no way to justify permanently keeping illegally acquired wide-scale data. I don't give a shite whose fault it is, I care about the decision being overturned. But there is an exactly 0% chance of that happening as long as everyone is slap-fighting over the degree to which 1 person is culpable and completely ignoring the actual issue in so doing.
fricking pathetic thread.

I've probably started more threads on NSA mass surveillance in the time I've been here than on any other topic

Is Trump the highest ranking executive authority, or is a judge the highest ranking executive authority? Does a ruling saying an action is legal mean that action must be taken?

This is also why I won't shed a tear if Trump ends up getting nailed because of SIGINT. His people are expanding that power
But I agree wholeheartedly with your NSA domestic surveillance sentiments.
