This is where the opinions, subjectivity, etc. of intelligence come into play, as well as the power of the head of the executive agency. This isn't even a comment on immunity.
So the first part you quoted assumes it's not a crime (that's what the word "if" means)
The 2nd part is a completely different framing than what you posted. Here you can compare them:

2 things. First, you're assuming the illegality when my post did not

The question is based around what criminal liability exists from that direction by the POTUS.
Second, the President is permitted to act in ways that would be illegal for anyone else to copy. The point of the portion you quoted was expanding on that and postulating that those following these Exclusively Presidentially Legal™ orders would also be insulated from criminal liability (as the underlying action was "legal" for the President).
