Because we aren't fricking stupid? You want to declare war on Iran for shipping insurgents over the border too? How about China?
Get these simple minded arse arguments out of here.

you’re either completely dishonest or a complete and utter bitch

I'm just not a fricking childish moron. The AEA gives us a mechanism to immediately expel foreign bad actors for the safety of our people, and still deal with the host nation with diplomacy.

And she knows this, but she's making that money.
Of course you’d say that—but you know you’re wrong unless you practice slip-and-fall law. Precedent is precedent. The Alien Enemies Act has been upheld, including post-WWII, confirming presidential authority over immigration in times of national security.
It doesn’t have to be an exact match for today’s situation—that’s not how precedent works. The courts apply broad legal principles when there’s a compelling government interest, like, I don’t know, an ongoing border security crisis and foreign nationals flooding into the country unchecked.
You’re just hoping people here don’t know that precedent covers the principle, not just the historical moment.

It literally only comes into effect while we’re at war. Declared or invaded.

No No NO!
Sammy says we either have to put these people before an asylum court, and risk releasing them back into the country, or declare war on everyone. Those are our only two options.

yes, obey the law or obey the law
If they are gang members they don’t qualify for asylum.

I know you just made that up because it isnt true.

in just talk about how dumb this is again. literally none of that is correct.
1. It is designed for declared war and foreign invasion. Everyone and every court acknowledges this is a war power of the President .
2. it isn’t limited to bad actors. It is literally everyone from the country we’re in conflict with.
that’s a cartoonishly dumb thing to say.
“why declare war when we can use the AEA”
you mean the state that comes into effect whenever we declare war?
idiot.
you think Venezuela is sending violent invaders into our country and you want to deport then?

criminal history are reason to believe they had criminal history in their country.

fify. why are you back on this? Youve already admitted in this thread that war isnt a pretext.

The President is authorized in any such event, by his proclamation thereof, or other public act, to direct the conduct to be observed on the part of the United States, toward the aliens who become so liable; the manner and degree of the restraint to which they shall be subject and in what cases, and upon what security their residence shall be permitted, and to provide for the removal of those who, not being permitted to reside within the United States, refuse or neglect to depart therefrom; and to establish any other regulations which are found necessary in the premises and for the public safety.
wrong again.

This just isn't true. It is one of three, and not all have to be satisfied.

Sammy, it doesn’t have to be a formal war. The AEA has been used in undeclared conflicts and national security threats, including during WWI before a formal declaration, and post-9/11 under the ongoing War on Terror.
But even if you insist on the ‘war’ angle—designating cartels as Foreign Terrorist Organizations or recognizing them as national security threats qualifies under the same framework we’ve already used for decades.
So either way, the legal mechanism is there. This isn’t new, it’s just inconvenient for your argument.

All they have to do is feign retribution from their gang or a rival gang. shite, most of them were here on Biden Asylum claims. Which is one of the reasons AEA is being leveraged.

I think we are barking at the moon.

because you said it was a way get rid of bad actors while using diplomacy. it’s literally the opposite. it empowers the president to get rid of non-combatants while we are in military conflict.
quote:
all natives, citizens, denizens, or subjects of the hostile nation or government, being males of the age of fourteen years and upwards, who shall be within the United States, and not actually naturalized, shall be liable to be apprehended, restrained, secured and removed, as alien enemies.
All mean all.
How could you be so wrong about something we’ve gone over this many times.

Take the MAL documents case as an example.... The legal precedent was iron-clad. You had the PRA, we had the Clinton Sock Drawer Case, the FBIs mishandling of evidence, leaking, collusion, we even had a simultaneous Biden documents case... and the left STILL aggressively went after Trump - even after Biden lost, Smith refused to let it go.
The objective isnt the law, it’s to inflict maximum damage.
