She’s been charged with Murder 1 and simple burglary among other related charges.

That a first degree murder conviction alone doesn't qualify for the death penalty. It has to fit into a statutory list of aggravating factors for that under 905.4.

Which it does. As I pointed out, the victim was over 65, which falls under 905.4(A)(10). Your original post stated that the prosecution would have to prove the offender's intent in regards to the sheriff's former position. This is irrelevant, as the fact that he was over 65 alone is an aggravating circumstance.

No worries. It will be interesting to see how it shakes out. Many people up this way feel like there is more to the story. I could definitely see the DA recusing himself and allowing the AG to take over.

This was my initial impression but I’m not so sure now. She was charged with burglary and property damage so I think there’s something to that.
