She’s been charged with Murder 1 and simple burglary among other related charges.

There's at least one, and possibly two, other predicates for First Degree Murder that are supported by the facts.

I was referring to the death penalty, not the application of the first degree murder statute.

Huh? First degree murder carries a potential death penalty sentence. What's your point?

C.  Whoever commits the crime of first degree murder shall be punished by death or life imprisonment at hard labor without benefit of parole, probation, or suspension of sentence in accordance with the determination of the jury.

That a first degree murder conviction alone doesn't qualify for the death penalty. It has to fit into a statutory list of aggravating factors for that under 905.4.

Which it does. As I pointed out, the victim was over 65, which falls under 905.4(A)(10). Your original post stated that the prosecution would have to prove the offender's intent in regards to the sheriff's former position. This is irrelevant, as the fact that he was over 65 alone is an aggravating circumstance.

Yea I missed that in 905.4. My bad.

Assuming the AG’s office will probably handle it, will be interesting to see if they go that route.

No worries. It will be interesting to see how it shakes out. Many people up this way feel like there is more to the story. I could definitely see the DA recusing himself and allowing the AG to take over.

This was my initial impression but I’m not so sure now. She was charged with burglary and property damage so I think there’s something to that.
