I dont know how this provocation made it this far.

This is weak. No real evidence, and the evidence they have is too vague to act on and the provocation was to someone who the gun wasnt even pointed at?

He will read the instruction, but he won't allow the prosecution to speculate.

but getting the minor in possession of an illegal weapon charge thrown out is a HUGE win for Kyle

So the state has been calling Kyle a vigilante this entire time and the judge just asked how Rosenbaum became a vigilante when he saw Kyle pointing his rifle at Ziminsky and decided to chase Kyle.
The Prosecution are clowns!

He really shouldnt allow it at all.

First, there's no evidence of it. The testimony was based on the video and the stills were based on the video. All of it is too grainy to interpret if it was raised or pointed at anyone specifically. Secondarily, can you even prove that Rosenbaum saw his point the gun at Ziminsky? Ziminsky didnt act on provocation - Rosenbaum allegedly did. He just happens to be the guy who had threatened to kill Kyle twice at that point.

there is no evidence here.

prosecution literally made this evidence up out of thin air 5 days into the trial when they think they found something on some grainy footage.

it should never have been allowed.

Illegally having gun as minor - Dismissed. Not having that on table for jury is huge.

Zaminsky has legal issues and cant be relied on as a truthful witness. He's a liar, just like Gaige has proven making the media rounds after his testimony.

But are you surprised? The entirety of the left is still strutting around pretending that Kyle was a Klansmen out hunting negroes.

Also, having it dismissed right now, is huge. It basically says that the court knows Kyle was legally carrying the firearm.
