I still have not found "subject to the jurisdiction thereof" except the one opinion discussing England and the king and his subjects but again none of that actually dealt with an illegal so there is a small chance that the court could interpret that differently
I know England now has different laws that disallow it. Perhaps ... like Roe, the original interpretation was wrong.
