1. Although it is called the Supreme Court that is actually not the high court of New York. This can be appealed by the state if it wants to.

2. It didn't say mask mandates are unconstitutional. It simply said such mandates have to be legislature passed. Not Governor actions.

3. The Dems control the "congress" of New York and will pass them. Bills are already written up and can be passed today, but they are waiting on whether the governor wants to "sue this all the way up to the Court of Appeals" as the case may be.

This is just one state district judge. The NY court of appeals is going to overrule him.

This is how it should have been from day one. If a student (or the student’s parent) or a teacher wants to wear a mask, they should have the right to do so. But that’s as far as it should go. There should be no one compelled to wear a mask.

And for those choosing to wear a mask, that should be good enough. After all, if your mask works then it shouldn’t matter who else is or isn’t wearing a mask. And if you’re worried you wearing a mask isn’t enough, forcing someone else to wear a mask that you yourself have no confidence actually works makes absolutely no sense.

This is where the pulling back will happen. Democrats will use judges in liberal states to pull back from Covid all the while complaining about it to keep their constituents happy.
