There is an issue with the criminal justice system as a whole. There are poor people that get railroaded and unjustly sit in jail.
The difference here is that these J6 people are being targeted and treated differently solely for their political beliefs. That is not comparable to the systemic issues with the justice system. It is a far more nefarious and “fascisty” than the issues in state courts all over the country.
