I've been in court probably a thousand times. I've never heard that used in the "law game". Phyrrhic victory I have heard. But never hollow.
Also...since you are in the "law game". You should know what Brown is saying he will not enforce. You and I both know what they will be used for.

That's only part of what he said. He IS sending the CA NG to the border, where they will focus on the illegal drug trade and sex trafficing, that sort of thing. He said they will not enforce federal law, which obviously means the CA NG will not be turning illegals over to ICE, and they probably won't stop the "law abiding" illegals who cross the border from getting into CA either.

BS. Stopping sex trafficking and drugs is border security and immigration enforcement . He is just trying to appease his base.

It's not BS, he did not say " our NG will not be guarding the border" he said they won't be enforcing federal immigration law. Two entirely different thigs.

You mistake anger with amusement. I am amused you, a PI lawyer, have the gall to insult anyone else's profession. PI lawyers are the least respected section of the bar.....by far.

I was at the Midland, TX airport last week and there were a lot of Chinooks taking off. The airport security said they the were the CA national guard. I asked if they were heading to the border. He said they were heading to Fort Hood (but then probably the border).

Actually he's right 73. It depends on which article the president requested the NG.
In this case it was article 32 which leaves command and control under the governor's discretion with the federal government footing the bill for the expense.
Under article 10 the troops would be under command of DoD and thus, the president. That's not what he used in this instance.

When the President nationalizes the NG they come under the command of the Army , which is why Posse Commitatus then comes into play. The law allows the NG to act as a police force within the Unites States but only if they are under state control (the law , of course, allows exceptions for national emergencies, which must be declared by POTUS)
