In the motion, Gray said that bodycam footage of the arrest shows a "white spot" on Floyd's tongue — which disappeared moments later. He also argued that Floyd, at the time, was in the process of swallowing "2 milligrams of fentanyl, a lethal dose" to avoid being caught with the drugs on his person. "All [Floyd] had to do is sit in the police car, like every other defendant who is initially arrested. While attempting to avoid his arrest, all by himself, Mr. Floyd overdosed on Fentanyl," Gray wrote in the motion. "Given his intoxication level, breathing would have been difficult at best. Mr. Floyd's intentional failure to obey commands, coupled with his overdosing, contributed to his own death."

My educated guess is that Floyd was jacked up on Meth when the cops first encountered him which accounts for the erratic behavior. Much of the BS he was pulling while in the car could have also been a distraction or delay so he could get the Fentanyl out of his possession and into his mouth. You see the Fentanyl taking effect later in the bodycam video.

Furthermore...

"Put simply, Mr. Floyd could not breathe because he had ingested a lethal dose of fentanyl and, possibly, a speedball," a portion of the motion read. "Combined with sickle cell trait, his pre-existing heart conditions, Mr. Floyd's use of fentanyl and methamphetamine most likely killed him. Adding fentanyl and methamphetamine to Mr. Floyd's existing health issues was tantamount to lighting a fuse on a bomb." Further, Hennepin County Medical Examiner Dr. Andrew Baker also added that if Floyd were found dead in any other circumstance — in this case, "home alone and no other apparent causes, this could be acceptable to call an [overdose]." The Hennepin County Medical Examiner's office ruled Floyd's death a homicide, determining that he died because of "cardiopulmonary arrest complicating law enforcement subdual, restraint, and neck compression." However, the autopsy report found no apparent bruising or trauma to Floyd's neck, neck muscles, or back as a result of the restraint.

At this point it wouldn't matter if video surfaced showing him shooting himself in the head at some point in the encounter. It certainly wouldn't matter in the court of public opinion, and I don't think it would matter in the accused cop's trial either.

Fentanyl is a drug that affects the respiratory system, respiratory depression. It also affects mode swings and slows heartbeat. He OD'd on drugs. He was complaining that he couldn't breathe in the squad car.

The issue becomes the second degree murder charge which requires intent. It will be more difficult for prosecutors to prove if true.
At best this an involuntary manslaughter case.

Too bad they didn't charge him with involuntary manslaughter. Minnesota AD got his Jimmies ruffled and reached for the stars for nothing.

Chauvin will get these charges dropped or acquitted and Minneapolis will burn some more.

Maybe by that time, trump will have won, utilized the insurrection act and we can start shooting some of these people.

Doesn’t matter now. The media got their prop.
They were hunting for a story and found this one when the Georgia one fizzled.

Again, "recreational" narcotic levels in an addict can be 20X that of a lethal dose in opioid naive individuals. Simply measuring a high bloodstream concentration isn't necessarily diagnostic.

The issue is timing. Fentanyl is rapidly acting. It's going to have peak effect within 3-5 min. In other words, had Floyd overdosed himself earlier in the day, or even in the store at some point prior to checking out, he'd have been unconscious long before the police encounter.

But swallowing a load during the arrest, times out exactly. In addition to respiratory depression, fentanyl can lead to chest wall rigidity immediately after dosing. Chest rigidity would make it hard to breathe, even before any profound sedation impacted. It is a rare side-effect, but it happens. Floyd may have experienced that effect.
