He has the authority to re-station any personnel there without Congressional approval. Not sure about the prisoners though. Along those lines though, he hasn't let things like laws stop him from rewriting time frame on various ACA implementations even though that's exclusively the territory of Congress (due to the wording in the ACA that sets specific dates).

As if. If he really wanted it he'd whip congress into shape. Either he changed his mind or else it sunk very low on his priority list. So it gives him a convenient excuse.
