Welcome to Toddy's america...where whitey is charged with crimes for being white. Where it's okay to publicly harass people with dissenting opinions but not ok for whitey to do so.

Hate crime charges were definitely more justified in that case than this. This seems absolutely absurd on it's face.

I find it very interesting that it depends on the flag, not the action, to determine whether or not hate crimes are charged.

No, the entire premise of "hate crimes" is what's absurd.
There should be no more or less charges for assaulting a 92 year old Mexican man than would be for assaulting a 92 year old white man.
The reason one is being charged and the other isn't is because people like you wanted hate crimes laws to be arbitrarily applied.
It's pathetic for you to call this absurd when you're getting the EXACT outcome that you wanted.

Hate crimes are the very definition of First Amendment violations. You have a situation where the act and mental state are by definition already being punished, and the only thing left is belief/thought.
Motive is also already factored in to proving the mental state and act (actus reus and mens really).
If you are for hate crimes you are categorically against the First Amendment. Period.
