You don’t have to go home, but you can’t stay here.

Nowhere in the law does it say that members of a terrorist organization can't be deported because it would be mean. In fact, the law says that use of this act is not up for judicial review

Oof...that is not what is in the constitution...the 14th amendment specifically

Trump declared a terrorist organization no one but him he makes things up hour by hour . You cannot take the law into your own hands just because it suites your agenda .

My position is it's silly to think a district court can have the whole f'n country as a party before him

they don’t need the whole
country, the defendants are various executive officers and agencies including Trump.

He can’t defend it but also would never say anything that might appear to be in favor of OMB so he doubles down

Agree. That’s exactly what the judge did. So you support impeachment ?

not subject to judicial review by any lower court.

This is interfering with an official governmental proceeding by these judges.

(where have you heard that before? J6ers)

Judge A in District A has no authority outside of District A.

Unfortunately our federal laws are not written that way

As long as the court has subject matter jurisdiction and personal jurisdiction the authority of the court on the issue presented to it would cover Virtually everything Specially if it's involved interstate commerce

I am firmly against the ability to issue a temporary injunction based on the allegations of one party without the participation of a second party And for no real appellate review Initially and I think Congress could change that

Hard to say.

If the DJ decides properly on the PI, a matter of weeks. If he rules incorrectly, the Administration will almost certainly pursue an expedited appeal, in which case another month or three at the Circuit. If it goes all the way to SCOTUS, longer.

All that also does not address the potential of orders enjoining enforcement during appeals

Exactly, and this is why I argue all of this bullshite, in practice, puts the judiciary head/shoulders above the executive and legislative branches.

It's asinine.

This isn't an unchecked power though.

Sure it is. It's about running out the clock on an administration's policy and in this view, it is unchecked power.
