For what?

For whatever is in question in the civil case. I'll just give you some links.

LINK

quote:

In civil litigation in federal court, a witness’s invocation of the Fifth Amendment may give rise to an adverse inference “when independent evidence exists of the fact to which the party refuses to answer.”

LINK

quote:

In some civil cases (though not in California), the opposition may be entitled to an instruction advising jurors that they can draw an "adverse inference" against a witness who claims the Fifth. This can be a very damaging instruction, as it allows the jury to presume that, had the defendant answered the relevant questions, the answers would have been adverse to his interests.

Um who got wronged?

I used to be pro choice. Then I had my daughter and now I'm prolife. I'm not apologizing to those on either side of that argument just because I changed my stance... Based off of my personal experience. Is that hard to understand?

Assuming you attacked the character of specific pro-life people, then, yes, you owe them an apology assuming you know who they are.

I get it. This is politics and politicians attack each other. I am just not buying the fact that Trump had some moment of revelation.

He found himself in a position where he had to contradict criticisms he has levied on others a half dozen or more times and is backtracking. Even with his backtrack, he had to add in words implying that his situation is different than the others.

Sir. Do you think there is just a bit of difference in a civil case about some tax assessment and a Federal crime against the United States of America?

He isn’t in federal court and adverse inference isn’t as damning as you think.

Not sure exactly what you are asking. Yes, I know this is a civil case and not a criminal one. I understand the difference.

That said, you can't plead the fifth merely to avoid stating something that might harm your case in a civil trial. If they asked me in a deposition if I made some contractual agreement, I am not allowed to plead the fifth simply because my answer will harm my civil case. Since answering the question would not put me in legal jeopardy (unless I lied of course), I can be forced to answer it.

You can only claim the fifth if answering the questions might put you in criminal jeopardy.

I believe most states have the same rules with regard to this. Obviously, the one link I posted stated that California does not allow adverse inference to be assumed.

I made no claim about how damning it is. Just stated it as a side point.

But I will say, if I had a similar legitimate moment of enlightenment, the first thing I would do is offer an apology to those I previously attacked.

I bet the parents of 13 service members Biden got killed are still waiting on their apology. You think?
